3 No Guarantee of Service Availability
Submitting a request through this Website does not create a service agreement.
NovaTech IT reserves the right to accept or decline any service request for any lawful reason, including but not limited to scheduling limitations, safety concerns, geographic limitations, unavailable parts, unavailable personnel, or conflicts of interest.
4 Estimates
Any estimate provided by NovaTech IT is offered in good faith based on the information available at the time.
Estimates are not guarantees. Actual costs may change if additional issues are discovered.
Costs may also change if:
- Hidden damage exists
- Equipment differs from the information originally provided
- Additional labor becomes necessary
- The customer requests additional work
- Third-party products or services change in price
NovaTech IT will make reasonable efforts to obtain customer approval before performing significant additional work.
5 Payment Terms
Unless otherwise agreed in writing:
- Payment is due upon completion of service
- Project work may require a deposit
- Hardware, software, licensing, and special-order items may require advance payment
- Business customers with approved billing arrangements may receive invoices with separate payment terms
NovaTech IT reserves the right to suspend or decline future services for unpaid balances. Customers are responsible for any applicable taxes unless exempt by law.
6 Customer Responsibilities
Customers agree to:
- Provide accurate information
- Provide reasonable access to equipment
- Maintain legal ownership or authorization to service the equipment
- Maintain valid software licenses
- Provide required passwords or access credentials when necessary
- Remove or disclose encryption that prevents requested work
- Ensure a safe work environment
Failure to provide necessary access or information may delay or prevent service.
7 Data Backup Responsibility
⚠️ This is one of the most important provisions of these Terms. Customers are solely responsible for maintaining current backups of all important files before any service begins.
Computer repair, operating system installation, hardware replacement, malware removal, software troubleshooting, storage device repair, and similar services carry an inherent risk of data loss.
NovaTech IT offers backup services and may assist customers in creating backups when requested. However:
- Backup services reduce risk but cannot eliminate it
- Not all damaged or corrupted data can be recovered
- Backup integrity cannot always be verified until restoration is attempted
- Recovery from hardware failure, ransomware, accidental deletion, or software corruption cannot be guaranteed
Unless otherwise agreed in writing, NovaTech IT shall not be responsible for the loss of data, software, photographs, videos, emails, documents, or other digital information.
8 Workmanship Warranty
NovaTech IT stands behind the quality of its workmanship. Unless otherwise stated in writing, NovaTech IT provides a thirty (30) day workmanship warranty beginning on the date the original service is completed.
This warranty covers defects directly related to the original labor performed by NovaTech IT.
This warranty does not cover:
- User error or accidental damage
- Physical abuse, power surges, lightning, water damage, or fire
- Manufacturer defects
- Internet service provider issues
- Software updates released after service
- Malware infections occurring after service
- Third-party modifications or customer-installed software
- Customer configuration changes
- Hardware failure unrelated to the original repair
If NovaTech IT determines that a reported problem is unrelated to the original service or resulted from a new issue or user action, additional service charges may apply. Manufacturer warranties remain the responsibility of the manufacturer.
9 Remote Support
Some services may be performed remotely. By requesting remote support, the customer authorizes NovaTech IT to access the device remotely for the purpose of diagnosing, configuring, repairing, or maintaining the system.
Customers understand that remote support may require internet connectivity, remote-access software, and temporary administrative privileges.
Customers may terminate a remote session at any time; however, doing so may prevent completion of the requested service.
10 On-Site Services
Customers requesting on-site service agree to provide a reasonably safe working environment. NovaTech IT may refuse or discontinue service if conditions present an unreasonable risk, including but not limited to:
- Aggressive animals
- Unsafe electrical conditions
- Structural hazards
- Threatening behavior
- Illegal activity
- Unsanitary conditions
Additional trip charges may apply if service cannot be completed due to customer-related circumstances.
11 Networking and Wi-Fi
Wireless networking performance depends upon numerous factors beyond NovaTech IT's control, including building construction, distance, signal interference, neighboring wireless networks, internet service provider performance, customer-owned equipment, and device compatibility.
Accordingly, NovaTech IT cannot guarantee:
- Specific internet speeds
- Complete wireless coverage
- Interference-free operation
- Compatibility with every device
Recommendations are based upon information reasonably available at the time of service.
12 Security Camera Systems
NovaTech IT may install, configure, or troubleshoot security camera systems. Customers acknowledge that:
- Security cameras reduce risk but cannot prevent crime
- Camera systems cannot guarantee detection or recording of every event
- Internet outages, power failures, equipment failures, weather, software updates, or third-party cloud services may affect system performance
NovaTech IT makes no representation that any security system will prevent theft, injury, property damage, or other criminal activity.
13 Smart-Home Devices
NovaTech IT may configure smart-home products manufactured by third parties. Customers understand that:
- Manufacturers may discontinue products
- Mobile applications may change
- Cloud services may be modified
- Features may be removed without notice
- Compatibility may change after software updates
NovaTech IT cannot guarantee continued compatibility with third-party services.
14 Third-Party Hardware and Software
NovaTech IT frequently installs or configures products manufactured by third parties. NovaTech IT is not responsible for:
- Manufacturer defects or product recalls
- Licensing restrictions
- Subscription changes
- Software updates released by third parties
- Service interruptions caused by third-party providers
Warranty claims for third-party products remain with the manufacturer unless otherwise required by law.
15 Intellectual Property
All content on this Website — including text, graphics, logos, layouts, images, and original materials — is the property of NovaTech IT or its licensors and is protected by applicable intellectual property laws.

You agree to indemnify and hold harmless NovaTech IT from claims, damages, liabilities, costs, and reasonable attorneys' fees arising from your misuse of the Website, violation of these Terms, infringement of another's rights, or unlawful conduct.
19 Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the State of Tennessee, without regard to its conflict-of-law principles.
20 Dispute Resolution
The parties agree to attempt to resolve disputes through good-faith discussion before initiating litigation.
Unless otherwise required by law, any legal action relating to these Terms or the services provided shall be brought in a court of competent jurisdiction located in Tennessee.
21 Severability

Failure by NovaTech IT to enforce any provision of these Terms shall not constitute a waiver of that provision or any other right.
